Interference with Contractual Relationships |

After a week long trial, a Hidalgo County jury awarded ModesettWilliams client Dr. Audrey Jones $829,000 against Weslaco hospital Knapp Medical Center. With prejudgment interest, the total verdict will be valued in excess of $1,000,000. The jury unanimously found that Knapp intentionally interfered with Dr. Jones’ agreement with Knapp’s emergency room provider, Mid-Valley Emergency Physicians. Jack Modesett and Walter Williams represented Dr. Jones and Dr. Nga Goodahl.

Real Estate Fraud |

Following a 10-day jury trial, a Bexar County, Texas jury awarded PRSA (client of ModesettWilliams) a verdict in excess of $1,000,000 against Indiana-based San Antonio Properties, L.P. and its limited partners. The jury ruled in favor of the plaintiff, PRSA, Inc. determining that they had been the victim of fraud, negligent misrepresentation, and fraudulent transfers. |

Breach of Contract, Fraud and Piercing the Corporate Veil |

After a two-week jury trial, a Travis County, Texas jury awarded KFP Brooks Building, Ltd (client of ModesettWilliams) a verdict in excess of $10,000,000 against Switch and Data Company, based in Tampa, Florida. The jury found for the plaintiff on all claims submitted to them including: breach of contract, negligent misrepresentation, fraud, and piercing the corporate veil. The verdict included $5,000,000 in punitive damages after the jury found by clear and convincing evidence that Switch and Data had committed both common law fraud and statutory fraud. |

Harm to a Child |

After a one-week jury trial, a Williamson County, Texas jury awarded SP, a minor child, (client of ModesettWilliams) a verdict in excess of $1,000,000 for sexual assault and battery by an adult resident of Williamson County. A resident who happened to be the victim’s next-door neighbor and school band director. The accused is currently serving a seven-year jail sentence, courtesy of the Texas penal system. |

Prescription Drug Case |

On behalf of a large group of individual plaintiffs, the attorneys of ModesettWilliams pursued the drug manufacturer Merck over the manufacture, marketing, and sale of the pain medication Vioxx. This dangerous drug caused thousands of heart attacks and strokes in the United States. Merck agreed to a nationwide multi-billion dollar settlement. |

Nursing Home Litigation |

ModsesettWilliams has successfully represented hundreds of individual plaintiffs in nursing home negligence cases throughout Texas. Because of their efforts, national nursing home chains have been held responsible for inflicting catastrophic injuries upon residents. Cases typically involved bedsores, dehydration, malnutrition, medication errors, falls, amputation, and death. In one case, a nursing home regularly left a resident lying in the resident’s own waste, resulting in large bedsores, malnutrition, and infection. ModesettWilliams took a seven-figure verdict against the nursing home. The owner of this particular nursing home is serving a lengthy jail sentence in a federal penitentiary for defrauding the federal government. Such cases sometimes involve unraveling the myriad of corporate shell companies which attempt to hide the assets of the responsible party. ModesettWilliams is familiar with these cover-ups and knows how to expose them in court. |

Jack Modesett has represented numerous families and individuals, from Oklahoma to South Texas, injured or killed in collisions with 18-wheeler trucks and other large commercial vehicles. In one case, a small town volunteer ambulance driver collided with an 18-wheeler that had failed to pull over to the shoulder when all of its lights failed. The collision resulted in catastrophic injuries to our client, another EMT, and the death of the patient. The case was settled to the satisfaction of all parties. |
